OVERVIEW

These Terms & Conditions govern your use of services provided by Mellow & Mend Massage Therapy, a DBA (Doing Business As) of KD Massage and Bodywork LLC, located in Mentor, Ohio. By booking an appointment, purchasing a gift card, or using any service offered by Mellow & Mend, you agree to the following terms in full. Please read them carefully.

SCOPE OF PRACTICE

Massage therapy services provided by Mellow & Mend are for therapeutic and relaxation purposes only. Massage therapy is not a substitute for medical care, diagnosis, or treatment.

  • Mellow & Mend does not diagnose medical conditions, prescribe medications, or provide medical advice of any kind. These activities are outside the scope of practice of a Licensed Massage Therapist.

  • Clients with medical concerns, injuries, or conditions are strongly encouraged to consult their physician or licensed healthcare provider before booking a session.

  • If you have questions about whether massage therapy is safe for your specific health situation, consult your doctor prior to your appointment.

  • Nothing communicated during a session — verbally or otherwise — should be interpreted as a medical diagnosis, treatment plan, or prescription.

ELIGIBILITY

  • You must be 18 years of age or older to book an appointment with Mellow & Mend.

  • Prenatal massage services are available only to clients in their second or third trimester of pregnancy.

  • Certain services have specific contraindications. It is your responsibility to disclose all relevant health information on your intake form prior to your appointment. Mellow & Mend reserves the right to decline or modify services based on health history.

HEALTH INTAKE FORMS & CONFIDENTIALITY

  • All new clients are required to complete a health intake form prior to their first appointment. Returning clients must notify their massage therapist of any changes to their medical history before each subsequent appointment.

  • Health intake forms are collected and stored through Acuity Scheduling. By completing your intake form, you consent to your information being stored within that platform in accordance with its privacy and data protection policies.

  • You are required to complete your intake form truthfully and completely. Providing inaccurate or incomplete health information may affect the safety and appropriateness of your session. Mellow & Mend assumes no liability for adverse outcomes resulting from incomplete or inaccurate intake information.

  • All client information — including health history, session notes, and any personal information disclosed during your appointment — is strictly confidential and will not be shared with any third party without your explicit consent, except as required by a court of law or applicable legal obligation.

SESSION CONDUCT & CLIENT RESPONSIBILITIES

  • Massage and bodywork services are strictly therapeutic and non-sexual in nature. Mellow & Mend maintains a professional environment at all times.

  • Inappropriate, sexual, or abusive behavior, language, or actions — directed toward the massage therapist or otherwise — will not be tolerated under any circumstances. Any session in which such behavior occurs will be terminated immediately, and full payment for the session will be collected.

  • In accordance with Ohio law, clients will be draped with a sheet throughout their session at all times. Draping will only be adjusted as needed to access the area being worked on, and your comfort and privacy will be maintained at all times.

  • Any pain, discomfort, or adverse sensation experienced during your session must be communicated to your massage therapist immediately so that techniques and pressure can be adjusted accordingly.

  • Mellow & Mend is not liable for pain or discomfort experienced during or after a massage session, particularly where the client failed to communicate discomfort during the session or provided inaccurate health history information.

RIGHT TO TERMINATE A SESSION

Both the client and the massage therapist have the right to terminate a massage session at any time and for any reason, without penalty — with the exception of sessions terminated due to inappropriate client conduct, for which full payment is required.

PAYMENT TERMS

  • Mellow & Mend accepts cash and credit card payments.

  • A valid credit card is required on file at the time of booking to hold your appointment. Your card will not be charged at the time of booking or prior to your appointment.

  • Payment for services is collected at the time of your appointment.

  • Applicable Ohio sales tax will be added to all services and gift card purchases at the time of sale.

  • All sales are final. Mellow & Mend does not offer refunds for completed services.

CANCELLATION & NO-SHOW POLICY

Your appointment time is reserved exclusively for you. Out of respect for that time, the following policy applies:

  • Cancellations or reschedules made with at least 24 hours' notice will not be charged.

  • Cancellations made with less than 24 hours' notice will result in a charge equal to the full cost of the scheduled service to the card on file.

  • No-shows — clients who do not arrive for their scheduled appointment and do not contact Mellow & Mend — will be charged the full cost of the scheduled service to the card on file.

  • If you are feeling unwell, please contact Mellow & Mend as soon as possible to reschedule your appointment. We appreciate advance notice and will work with you whenever possible.

  • Mellow & Mend reserves the right to cancel or reschedule appointments at any time. In such cases, clients will be notified as promptly as possible and no cancellation fee will be charged.

GIFT CARDS

  • Mellow & Mend gift cards are available for purchase and may be redeemed for any service offered.

  • Gift cards do not expire.

  • Gift cards are transferable and may be used by anyone.

  • Gift cards are non-refundable and have no cash value.

  • There are no restrictions on gift card amounts.

  • Applicable Ohio sales tax will be charged on services redeemed using a gift card at the time of redemption.

  • Mellow & Mend is not responsible for lost, stolen, or damaged gift cards.

LIABILITY & INSURANCE

  • Mellow & Mend carries professional liability insurance through the Associated Bodywork & Massage Professionals (ABMP).

  • By booking an appointment, clients acknowledge that massage therapy involves physical touch and that, as with any bodywork, there is an inherent risk of minor discomfort or soreness. Clients accept this risk by proceeding with services.

  • Mellow & Mend is not liable for personal property lost, damaged, or stolen on the premises.

  • Mellow & Mend assumes no liability for adverse outcomes resulting from a client's failure to disclose relevant health information, failure to follow post-session care recommendations, or misrepresentation of health status.

WEBSITE & DIGITAL USE

  • The Mellow & Mend website (mellowandmend.com) is provided for informational purposes and booking only. All content is the property of KD Massage and Bodywork LLC and may not be reproduced without written permission.

  • By submitting a contact form, booking inquiry, or email communication through the website, you consent to being contacted by Mellow & Mend in response to your inquiry.

  • Mellow & Mend uses Acuity Scheduling to manage appointments and client data. Use of that platform is subject to Acuity's own Terms of Service and Privacy Policy in addition to these terms.

GOVERNING LAW

These Terms & Conditions are governed by and construed in accordance with the laws of the State of Ohio. Any disputes arising from these terms or from services provided by Mellow & Mend shall be subject to the jurisdiction of the courts of Lake County, Ohio.

CHANGES TO THESE TERMS

Mellow & Mend reserves the right to update or modify these Terms & Conditions at any time. Changes will be posted on this page with an updated effective date. Continued use of services following any changes constitutes acceptance of the revised terms.
